1. Terms of Use
1.1. Definitions and terminology:
Bureau: Civil Service & Government Development Bureau
The competent administrative unit (HRISC): Human Resources Information Systems Centre
Mawared: Mawared is a unified e-platform for managing the human resources of the Government of Qatar as a part of the Qatar Digital Government Strategy.
Platform: the electronic system that allows the employees of government and government funded organizations inside Qatar to register and utilize the e-services provided by the competent administrative unit (HRISC): Human Resources Information Systems Centre, at CGB.
Information: All data and content of the Service processed and made available through or linked to the Platform from files, programs, policies, forms, documents, software, databases, and what it contains in terms of data files, written text, images of documents or other photographed or written material.
User: The member who has been authenticated and successfully logged on to the Platform and gained access to utilize the e-services.
Browser: A platform visitor who has not been authenticated / logged on through the platform and has access to all contents and materials on the platform.
Mawared Mobile App: Mawared Mobile application: electronic services provided by the competent administrative unit (HRISC) on the mobile phone for the users who are employees of government agencies or agencies whose budget is funded by the state, such as leave requests, approval of applications, administrative certificate applications, and other services, through developed and secure channels.
Device Data: Device-specific information such as device model, operating system version, and unique device identifiers will be collected….
Log data: Anytime you use our service, to improve the user’s experience in the event of an application error, we collect data and information through application log data. This log data may include information such as the Internet Protocol ("IP") address of your device, device model, operating system version, configuration of the app when utilizing our Service, the time and date that the user accessed the service, and other statistics.
1.2. Acknowledgment and acceptance of the Terms of Use
i. By using this platform, the user has accepted the conditions mentioned below, and the Bureau reserves the right to review the stated conditions at any time and conducts any amendment or change in these terms without prior notification.
ii. The user shall be responsible for periodic verification of any amendments and the continued use of the platform in the light of any modifications to the terms and conditions contained therein shall be regarded as acceptance by the user of those amended terms and conditions.
1.3. The scope of the undertaking and the obligations within its scope
i. The user is bound to provide all the information required for registration in a correct and proper manner according to the form prepared for the registration process. The user acknowledges that the identity and other data such as documents, records, certificates and qualifications that he attaches through the platform, whether during the registration process or during the sign-up process, are correct and valid information and that he will be responsible for any false statements or incorrect or fraudulent information sent from him.
ii. In the event that the data is confirmed to be incorrect, the Bureau has the right to take legal measures in accordance with the laws, regulations and policies in force in the country.
iii. The user must notify the Bureau immediately in case of losing his account data or the username or any unauthorized use of his account.
iv. A user is prohibited from impersonating any person, wrongly identifying himself or using another user's account without his / her permission.
v. The user is bound by all applicable laws and regulations, including those relating to data transmission, and to verify that the subject, content, and terms of information and e-mail do not contain, without limitation, hatred, indecent, obscene, offensive, deceptive, or unlawful materials. Or violate the intellectual property rights of any party.
1.4. Confidentiality, Privacy and Data Protection
i. The user acknowledges the Bureau's commitment and responsibility for the security, confidentiality and privacy standards and policies of the information available through this platform. According to the data protection laws in the State of Qatar, including Law No. (13) of 2016 regarding protecting the privacy of personal data.
ii. The information available on this platform, including the listed services, may be copyrighted, or contain confidential information or this information is general not confidential and / or subject to the Terms of general Use licenses.
iii. The user undertakes not to disclose, publish, or forward any information or data obtained through his or her use of the Service to third parties.
iv. The permissible legal exception is that the Bureau allows for the user to provide this information only to the competent administrative unit (HRISC) in the event of a defect in the workflow process. It is also banned for the user to exploit this platform illegally or for personal interest purposes.
v. The user acknowledges that the Bureau has the right to retain, process and transmit information by the Bureau, recognizing that the privacy of the user's identity is maintained by Law No. (13) of 2016 concerning Protecting the privacy of personal data.
vi. The competent administrative unit (HRIS) will not collect the required information such as the Qatari ID card and personal identification information, but not limited to, the date of birth for documentation via the application, and it will be preserved and stored on the user's secure local storage device.
vii. The Mawared app does not use third party services that may collect information that used to identify your identity.
viii. It is not allowed for the receiving party to use the confidential information except for the purpose of implementing some or all of the provisions of this document.
ix. All confidential information remains the property of the disclosing party and it alone has the right to use this confidential information for any purposes without any obligation towards the receiving party.
x. Protection against unauthorized access, alteration, disclosure or destruction of information through regular review of our practices in the collection, storage and processing of information, including physical security measures.
xi. Personal information will be protected in accordance with Law No. (13) of 2016 regarding the protection of personal data, with high security standards and practices.
1.5. Controls measures for the content available on the Platform
i. The user undertakes not to misuse the information and data available on the platform in any way. In the event that the user misuses the privilege, the user will be subject to legal accountability, and the Bureau will not be responsible for the individual's misuse of this information in particular and the platform in general.
ii. The confidential information shall be used only for the benefit of the disclosing party or for the mutual benefit of both of them and shall be limited to the provisions of this document.
iii. Agreeing to the terms and conditions stipulated in this document is considered as an acknowledgment by the user not to use the platform, email, or any information available through them for any purpose that is unlawful or prohibited by the State of Qatar. Accordingly, it is prohibited to upload or exchange any software, files, or documents that contain harmful or damaged software or viruses or inappropriate and incorrect information.
iv. The Bureau shall not be responsible for any damages arising from: loss of data, or delays in operations for technical reasons, or viruses that disrupt access to the service or incompatibility between the service and other services, software and devices, or for the delay or inability to initiate or complete the user's communication, or misuse.
v. The user is prohibited to use the platform or the information available on it in any way that could damage, disrupt, or adversely affect the performance of any server or network, or any service interconnected with the services available in the Bureau, or the computer devices and systems or communication equipment. It is also banned to send, publish or copy any unauthorized content or infringe or violate the intellectual property rights of others. It is also banned to access or possess any information related to the Bureau through external tools or Programmes.
vi. The Bureau reserves the right to monitor any content uploaded by the user and it may, without prior notice, remove it or delete it in the event that the terms of use are violated or if there is an explicit violation of any clauses stipulated in the internal laws and regulations of the Bureau which have been previously approved by the competent department.
vii. The Bureau reserves the right at any time, to amend, cancel or suspend, without prior notice, any part of the services and the user agrees that the Bureau shall not be responsible towards him in any way due to the foregoing reasons.
viii. It is prohibited for the user to copy, publish or sell all or certain services for commercial purposes without a written permission from the Bureau. It is also banned to use the services in a way that violates any applicable laws or breaches any internet-related protocols
1.6. Intellectual Property Rights
i. Only the Bureau owns all rights related to all content available on the platform, for example, but not limited to, copyrights, patents and the name of the Bureau, and it solely is responsible for disposing of it in accordance with the laws of the data preservation policy.
ii. It is prohibited for the user to use or display such content for purposes contrary to this document without written authorization and the user is legally liable for any violation or breach of any of these rights.
iii. In the event of any violation or breach of these rights or intellectual property rights by a third party on the platform by either the user or others, please inform us by e-mail at IPcomplaint@cgb.gov.qa
1.7. Termination or Suspension of Service
i. The Bureau may be obliged to temporarily suspend the service for operational reasons such as systems maintenance, update, upgrade, or incidents without prior notification or specifying the period of suspension of the service.
ii. Any breach by the user of any of the conditions of the current terms of service will lead to revoke of his access or to the immediate termination of all transactions related to him without prior notice.
1.8. Divisibility of Terms
Cancellation of one or more of these terms - due to its unlawfulness or inapplicability - does not affect the effectiveness of the rest of the other terms.
1.9. Amendments
i. The Bureau reserves the right at any time to amend, cancel or suspend any part of the services without prior notice and does not commit or bear any responsibility for any errors or omissions in the content of the platform.
ii. The Bureau reserves the right to amend the privacy policy from time to time without prior notice, provided that the amended terms and conditions are published on the platform, with effect from the date of publication. As the user continues to use the platform, he or she agrees to be bound by the provisions of these updates and amendments.
1.10. Disclaimer of Responsibility
To the maximum extent permitted by law, we shall not be liable in any case, for any special, punitive, indirect, incidental or consequential damages of any kind or for any loss of reputation resulting from unintentional unauthorized uses, or unauthorized access or disclosure of your personal data.
1.11. Applicable law and competent courts
i. If any dispute or conflict arises between the two parties regarding the interpretation or application of this document, the two parties should try to settle it first through negotiation.
ii. If the two parties could not reach to a settlement, they may refer the dispute to the competent court in the State of Qatar.
iii. The courts of the State of Qatar are exclusively competent to consider any dispute that may arise between the two parties regarding the implementation of this document or the interpretation of any of its provisions, and Qatari laws shall be enforceable.
